Please read these terms and conditions carefully!

1. General

These terms and conditions govern all business relationships between the person being cared for/course participants and the midwifery practice “Hebamme Italiana” in the person of Claudia Arnold-Bertocco, hereinafter referred to only as midwife. Changes to the Terms and Conditions can be made at any time by posting the updated version online
is provided. These changes do not affect the rights and obligations that arose before the changes. The respective version at the time of supervision is valid; if care extends over a longer period of time with interruptions, it is the responsibility of the person being looked after to check whether changes have been made in the meantime when the care is resumed/attendance of a later course. In her work, the midwife uses the Hebamio software for administrative management, the digital documentation of her services, billing and quality assurance, as well as a video consultation platform certified by the GKV to carry out online services. The midwife can use the services of a billing service for the billing. It is the acceptance of all applicable terms and conditions,

2. Registration

The contract is concluded when the person being looked after/course participant registers online via the Hebamio software and the subsequent confirmation by the midwife. The person being cared for is obliged to provide truthful information about their state of health, any complaints and other personal (health) data, especially to inform the health insurance company and at the first personal contact to the
present your insurance card. A written course or treatment contract will be made at a later date
concluded between the parties.

3. Course Delivery

The courses are designed for a limited number of participants. If the required minimum number of participants is not reached, the midwife reserves the right to cancel courses. For urgent reasons, individual course hours can be postponed. Notification of this will be given in good time. In individual cases, the midwife can be represented by a colleague during the course if necessary.

4. Cancellation/Non-Participation

After booking, a course can be canceled in writing or by e-mail up to four weeks before it begins without incurring any costs. In the event of a later cancellation, the entire course fee will be charged. This is not covered by health insurance. Missed course hours are also to be paid for by the participants themselves. The reason for non-participation is irrelevant, with the exception of premature delivery or a serious illness certified by a doctor. Early termination before the end of the course is not possible, except for the reasons stated in the previous section.

5. Fees/Reimbursement

If you participate regularly, the statutory health insurance companies currently cover the costs of a birth preparation and/or postnatal course.
Privately insured people will receive a private invoice at the end of the course. We therefore recommend that you check with your health insurer in advance whether the desired midwifery services are covered. In any case, the participant is obliged to pay the bill, regardless of the reimbursement of costs by her private health insurance/aid. If the partner participates in the birth preparation course, the respective
Partner fee to be paid. A reimbursement of costs by the health insurer only takes place in exceptional cases and must be applied for by the participants themselves if necessary.
A deposit of €60 for the retraining course and €80 for the birth preparation course must be paid by bank transfer or in cash at the latest at the start of the course as security for course units that may not have been attended, which the participant then has to pay for herself in accordance with the Private Fees Ordinance of the State of Bavaria pay. This will be settled at the end of the course and any existing credit will be paid out again.
The administration fee charged for the courses corresponds to a voluntary, additional contribution on the part of the contractual partner to provide support in order to be able to offer the services as usual despite increased costs. The administration fee is not reimbursed by health insurance.

6. Liability

Participation in the course is at your own risk. The participant bears full responsibility for herself and her child. The midwife is only liable for injuries to life, limb or health in the event of intent or gross negligence. No liability is assumed for items brought in. The course instructor is responsible for the content/exercises.

7. Privacy and Confidentiality

As part of the courses and care, the personal data of the participants/those cared for and the born/unborn child are collected by the midwife as the responsible body, processed and used within the framework of the legal requirements. In addition to information about the person and social status (name, address, payer, etc.), this includes in particular the medical findings necessary for the treatment.
This data is only handled to the extent that this is necessary for the provision, billing or ensuring the quality of the midwife’s assistance.
The data will only be transmitted to third parties if the person being cared for consents or if there is a legal basis for this. The midwife is also subject to confidentiality towards other persons involved in the treatment (e.g. doctors, colleagues). However, the midwife will exchange the medically required data with these people if the person being cared for agrees or an emergency situation justifies this, especially if the person being cared for is not accessible and further help is urgently required.
The billing with public-law payers, in particular the health insurance companies, is done directly with them, either by the midwife directly or according to §301a Para. 2 SGB V via an external billing office. In the case of private patients or in the context of optional services, billing is done directly to the person being cared for, either directly by the midwife or with a separately declared consent via a
external clearing house. The midwife may contact you for (course) information by e-mail, e-mail distribution list, telephone, SMS or Threema.

8. Final Provisions

The law of the Federal Republic of Germany. Changes to these GTC must be in writing. This also applies to a change in the
written form requirement. If one or more provisions of these General Terms and Conditions are or become invalid or if the General Terms and Conditions contain a loophole, the contracting parties shall replace or supplement the invalid or incomplete provision with appropriate provisions that correspond as closely as possible to the economic purpose of the intended provision. The validity of the remaining provisions remains unaffected.
